These Terms and Conditions ("Agreement") govern the use of the GynicCare telemedicine application ("Application") by customers ("Customers"). By accessing and using the Application, Customers agree to be bound by the terms and conditions outlined below:
1.1. Customers may use the Application to acces telemedicine services provided by licensed doctors ("Doctors") through the Application's features and functionalities.
1.2. Customers must ensure that the information provided during registration and throughout their use of the Application is accurate, complete, and up to date.
1.3. Customers are responsible for maintaining the security and confidentiality of their login credentials and must not share their account information with any unauthorized individuals.
1.4. Customers shall use the Application in compliance with applicable laws, regulations, and these Terms and Conditions.
2.1. Customers understand that the Application provides access to telemedicine services, including medical advice, consultations, and information related to gynaecological health.
2.2. Customers acknowledge that telemedicine consultations may have limitations compared to in-person medical visits and that Doctors' ability to diagnose and treat conditions may be dependent on the information provided by Customers.
2.3. Customers are responsible for providing accurate and complete information about their medical history, symptoms, and any other relevant details required for proper evaluation and treatment.
2.4. Customers understand that Doctors will exercise their professional judgement in providing medical advice and treatment options, and that any decisions regarding treatment are the sole responsibility of the Customers.
3.1. The protection of Customer data and privacy is important to us. The collection, storage, and use of personal information provided by Customers are governed by our Privacy Policy, which can be found Here.
3.2. Customers understand that the Application may collect and process personal and health-related information for the purpose of providing telemedicine services, ensuring continuity of care, and improving the functionality and user experience of the Application.
3.3. The Application employs reasonable security measures to protect Customer data, but Customers acknowledge that no method of transmission or storage over the internet is completely secure, and the Provider cannot guarantee the absolute security of Customer information.
4.1. The Application is provided on an "as is" basis, and the Provider makes no warranties or representations regarding the accuracy, reliability, availability, or suitability of the Application for any particular purpose.
4.2. The Provider does not endorse or guarantee the quality or appropriateness of the services provided by Doctors through the Application. Customers acknowledge that the Provider is not responsible for any acts, omissions, or negligence of Doctors, and any issues related to the services provided by Doctors should be addressed directly with them.
4.3. Customers understand and accept the risks associated with the use of telemedicine services, including but not limited to technical limitations, interruptions, delays, or failures that may impact the delivery of services through the Application.
5.1. Customers agree to pay the fees for the gynaecological telemedicine services provided through the Application as agreed upon and specified by the Provider.
5.2. The Provider may use third-party payment processors to facilitate the collection of fees. Customers acknowledge that additional terms and conditions may apply to such third-party payment services, and the Provider is not responsible for any issues or disputes arising from the use of such services.
6.1. Customers acknowledge that all intellectual property rights related to the Application, including but not limited to software, content, logos, and trademarks, are owned by the Provider.
Customers shall not reproduce, modify, distribute, or create derivative works based on the Application or any part thereof without the prior written consent of the Provider.
6.3. Customers may only use the Application for personal, non-commercial purposes and shall not use, copy, or exploit the Application or its contents for any other purposes without the express written permission of the Provider.
7.1. Customers may terminate their use of the Application at any time by deleting their account or ceasing to access and use the Application.
7.2. The Provider reserves the right to suspend or terminate a Customer's access to the Application at any time without prior notice if the Customer violates these Terms and Conditions or engages in any fraudulent, illegal, or unauthorised activities.
8.1. To the maximum extent permitted by applicable law, the Provider, its affiliates, and its respective directors, officers, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the use or inability to use the Application, including but not limited to any medical advice or treatment received through the Application.
9.1. This Agreement shall be governed by and construed in accordance with the laws of India.
9.2. Any disputes or claims arising out of or relating to this Agreement or the use of the Application shall be resolved through good-faith negotiations. If a resolution cannot be reached amicably, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in [City], India, and the language of the arbitration shall be English.
10.1. The Provider reserves the right to modify or update these Terms and Conditions at any time. Customers will be notified of any material changes, and continued use of the Application after such modifications shall constitute their acceptance of the revised terms.
11.1. This Agreement constitutes the entire agreement between the Provider and Customers regarding the use of the Application and supersedes any prior agreements or understandings, whether oral or written.
12.1. If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
13.1. The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver of such provision or the right to enforce it in the future.By accessing and using the GynicCare telemedicine application, Customers acknowledge that they have read, understood, and agreed to comply with these Terms and Conditions.
